CK v SSWP (PIP); JM v SSWP (PIP) [2022] UKUT 122 (AAC) (5 May 2022)


Effect is to be given to Regulations 2(2) and 2(3) of the Social Security (Personal Independence Payment) (Amendment) Regulations 2017 (SI 2017/194) which, in particular, sought to reverse the Upper Tribunal's decIsion in SSWP v LB (PIP) [2016] UKUT 530 (AAC). The grounds of appeal based on (a) inadequate consultation (b) ultra vires and (c) breach of article 14 European Convention on Human Rights all fail.
